Acceptance of terms

By using the DumbSMM service (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.

Description of the service

DumbSMM provides tools for content planning, media storage, caption generation, carousel generation, video rendering, scheduling, and publishing to connected third-party platforms such as Instagram, TikTok, and YouTube.

Accounts and integrations

You may connect third-party accounts through official OAuth or other approved authorization flows. You authorize DumbSMM to access and use the connected account data and permissions necessary to provide the features you request. You are responsible for ensuring you have authority to connect and operate each account.

We do not ask for your third-party platform passwords when an OAuth flow is available. You can disconnect an integration in the Service, and some providers may also allow you to revoke access directly in your account settings.

Your content and permissions

You retain ownership of the content you upload or generate through the Service. You grant DumbSMM a limited, non-exclusive license to host, copy, process, adapt, render, transmit, and publish that content only as needed to operate the Service and carry out your instructions.

You represent that you have all rights, permissions, consents, and licenses necessary to upload, process, schedule, and publish your content, including rights relating to music, video, images, trademarks, likenesses, and personal data.

Platform and API-specific terms

Your use of connected third-party platforms remains subject to those platforms' own terms, community rules, developer policies, and API requirements. You may not use DumbSMM to bypass platform restrictions, impersonate others, evade enforcement, or violate any third-party terms.

If you connect a Google account for YouTube features, you authorize DumbSMM to use the Google and YouTube permissions shown on the consent screen solely to identify the connected YouTube channel and upload content you choose to publish. Google user data obtained through those APIs is handled as described in the Privacy Policy.

Prohibited use

You may not use the Service to:

violate any law, regulation, or third-party policy;
infringe or misappropriate intellectual property, privacy, publicity, or other rights;
upload malware, harmful code, or content intended to disrupt the Service;
abuse automation, rate limits, or scheduling features in a way that harms others;
use the Service to publish unlawful, fraudulent, deceptive, or abusive content;
attempt unauthorized access to any system, account, token, or data.

AI and automated outputs

The Service may generate captions, prompts, layouts, schedules, or other outputs using automated systems. You are responsible for reviewing generated outputs before publishing them. We do not guarantee that generated outputs will be accurate, lawful, original, or fit for any particular purpose.

Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time, including features that depend on third-party APIs or platform approvals. Third-party platforms may also change, limit, or remove access independently of DumbSMM.

Suspension or termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created security or legal risk, misused third-party platform integrations, or if continued operation is no longer feasible.

Disclaimer and limitation of liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, DumbSMM disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

To the maximum extent permitted by law, DumbSMM is not liable for indirect, incidental, special, consequential, or exemplary damages, or for losses related to platform rejections, posting failures, account restrictions, content performance, loss of data, or actions of third-party providers.

Changes to these terms

We may update these Terms of Use from time to time. The current version will remain published on this page with its effective date. Continued use of the Service after an update means you accept the revised Terms.
